Welcome to Terra Flying Ltd. ("Terra Flying", "Us", "We" or "Our"), a company registered in England and Wales (Company No. 5770063) whose registered address is at 5 Coxley Court, Rossington, Doncaster, South Yorkshire DN11 0FT.

These Web Site Terms and Conditions (the "Terms") govern your use of this terraflying web site (the "Site"). By accessing and browsing the Site you accept these Terms. If you do not agree to them please do not use this Site.

Pricing

Prices quoted on our web site include a standard delivery service worldwide. The price is subject to an additional surcharge should you opt for a recorded delivery service. Prices are subject to change in the event of promotions and / or to reflect market changes. All price changes will be clearly shown on the site so that you are fully aware of the current prices before making a purchase decision. Liability for any import duties for clients outside the UK is the responsibility of the purchaser. No surcharges are made for credit card payments.

Payment

Unless a credit account has been opened, goods will be despatched following receipt of cleared funds or, in the event of credit / charge card payments, once the transaction has been authorised by the credit card company. Please note that goods ordered by credit card must be delivered to the cardholders address unless a prior arrangement has been made with the credit card company.

To reduce the risk of credit card fraud Terra Flying reserves the right to refuse an order if the credit card transaction is not authorised. These checks do not breach any of your rights but are merely to protect the cardholder and ourselves from fraud.

Delivery of Goods

Terraflying use national carriers for the delivery of goods. Whilst every effort is made to ensure goods are received on the day specified we shall not be liable for any losses, costs, damages, charges or expenses caused by any delay in delivery of the goods.

For deliveries within the UK, we aim to deliver your product to you within 3 working days of cleared funds for your order. For all other countries, we aim to deliver to you between 3-7 working days of cleared funds for your order.

Should you request a recorded delivery service, it is the responsibility of the person ordering the goods to be available to sign for them at the time of delivery or, in their absence, an authorised person. The purchaser takes full responsibility for the goods once they have been delivered and signed for. Before goods are signed for, it is important that they are checked for any signs of damage. In the event goods are signed for unchecked or you suspect there may have been damaged during transit this should be noted on the carriers delivery documentation at the time of signing.

Delayed Despatch of Goods

Terra Flying will normally request payment when goods are in stock however in the unlikely event that we are unable to fulfil the order within 7 days of payment, a full refund will be made to the client.

Damaged Goods / Incorrect Goods

In the unlikely event that goods are incorrect, faulty or damaged Terra Flying must be informed within three working days of receipt. A replacement or full refund will be made. All product and packaging must be returned to Terra Flying for inspection. It is the responsibility of the purchaser to check the goods for quality and condition in the presence of the carrier. If there is a shortage or if any of the goods are received in an unsatisfactory condition you, or the recipient, must so endorse the carrier’s delivery document and contact us immediately. Once delivered and signed for the goods are the responsibility of the purchaser.

Returns Policy

If you feel sure that a product is faulty, please ensure that the problem does not lie elsewhere in your system. Please consult Terra Flying Technical FAQ’s on this site to eliminate any of the potential issues with the product first. If you still feel you have a faulty product please follow this procedure:-
All returns must be received within 14 days of the date that the request is logged by you to us i.e. no more than 3 working days after receipt. Upon logging the returns request, we will issue a returns number. It will take between 7 and 10 days to process your return, but we will do our best to reduce this time.
Returned items must be in original packaging.
We strongly recommend the package you are returning is fully insured. We suggest you use a service that can provide “proof of delivery”. Terra Flying will not be liable for items lost or damaged in transit.
All shipping back to Terra Flying is paid for by the customer. Please ensure the return has your returns number clearly marked on the outside of the package next to our address.
Any return found to be modified, altered, tampered with or not to be defective will result in no refund being made.
Any returned packages that do not clearly display a valid returns number will be refused, as will packages received over 14 days from returns issue date.

Material on the Site

All materials and content contained in this Site are the property of Terra Flying. The Content may not be used except as provided for in these Terms, without the written permission of Terra Flying. Where Content published on the Site is supplied by third parties, you acknowledge and agree that We cannot control and do not purport to endorse such Content in any way. All Content which is offered by third parties, is published in good faith but We do not (to the extent permitted by applicable law) accept any responsibility for the accuracy, reliability, timeliness, or otherwise of such Content (whether published on or offline) or for the use of such Content.

Your Use of the Site

You may only make use of the Content of this Site to the extent necessary to allow you to use the Site and the services provided through it. You shall not use the Content /and or Site for any illegal or immoral purpose, or otherwise link this Site to any other web site without our prior written consent. You agree that you will not:

use the Site for the posting or transmitting of any unlawful, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, racially, ethnically or otherwise objectionable material of any kind;

You acquire no rights or licences in or to the Site or any of its Content, other than the limited right to use the Site in accordance with these Terms or in order to use services available on the Site. All product and company names and logos mentioned in the Site are the trade marks or trading names of their respective owners, including Us. You may not modify, copy, reproduce, republish, disassemble, decompile, reverse engineer, create derivative works from, interfere with, display, circulate, upload, post, transmit or distribute, by any means or in any manner, any material or information on or downloaded from the Site, including but not limited to text, graphics, video, messages, code and/or software without Our prior written consent, except where expressly invited to do so, for example, in order to complete any test or questionnaire.

Your Creative Materials

It is Terra Flying’s policy not to accept or consider creative materials, ideas or suggestions other than those We specifically request. This is to avoid any misunderstandings if your ideas are similar to those We have developed independently. If you transmit to Us by electronic mail or otherwise, any communication or material, you will be deemed to have granted Us a perpetual, world-wide, royalty-free, irrevocable licence to use such communications or material in any way We deem fit. Terra Flying are free to use any ideas, concepts, know-how or techniques contained in any communication you send to the Site for any purpose whatsoever including, but not limited to, developing, manufacturing and marketing products using such information.

Where you must complete a registration process in connection with the Site you must provide current, complete and accurate information about yourself as prompted. You are solely responsible for all use of and for protecting the confidentiality of any username, email verification and password used by you in connection with the Site. You may not share these with any third parties. You must notify Us immediately of any unauthorised use of them or any other breach of security regarding the Site that comes to your attention.

Warranty and Liability

We do not accept liability for any losses or claims arising from any inability to access the Site or any failure to complete a transaction.

Whilst We use reasonable efforts to include accurate and up to date information in the Site, to the fullest extent permitted by law, We exclude all warranties, whether express or implied, or representations as to its accuracy, timeliness or completeness. We do not assume any liability or responsibility for any errors or omissions in the Content of the Site.

We assume no responsibility for the contents or privacy practices of any other web sites to which the Site has links. We shall not be held responsible or liable for any loss or damages caused by use of or reliance on any content, goods or services available on such hyperlinked sites.

Consequences of your breach of these Terms

You acknowledge that should you breach these Terms We may suffer loss and damage (which may or may not arise out of third party claims against Us due to any such breach committed by you). You agree therefore that you will reimburse Us all reasonable costs, losses and expenses (including any of our lawyers’ fees) incurred by Us, if they are incurred as result of any breach by you of these Terms.

Severance and Waiver

In the event that any provisions of this Agreement are held to be illegal, invalid or unenforceable, such provisions will be severed and the remainder of this Agreement shall continue in full force and effect. No waiver by Us shall be construed as a waiver of any preceding or succeeding breach of any provision.

Failure to Perform

We will not be held liable for any breach of these Terms by Us due to causes beyond Our reasonable control.

Amendments to these Terms

Terra Flying reserves the right to update these Terms at any time. These amended Terms will take effect from the time they are first published on the Site, and from then on will govern your use of it. If you do not agree with the amended Terms, you must cease to use the Site.

Entire Agreement

Save as otherwise expressly stated, these Terms contain the entire agreement between Us and you relating to the use of the Site and supersede any previous agreements, arrangements, undertakings or proposals, written or oral, between Us and you.
